PACIFIC LUMBER CONVICTED
After finding Pacific Lumber guilty of five violations of the Forest Practices Act on Friday, Judge Marilyn Miles yesterday fined PL/Maxxam Corporation the maximum fine under the California misdemeanor laws and revoked a prior probation.
Due to California's ridiculously weak state law, the maximum Miles was able to fine PL was a total of $13,150. California misdemeanor law would have allowed her to set terms for probation in lieu of the fine and a jail sentence of up to one year for each of the five counts -- if PL had been a human being. But neither PL nor Maxxam, its multi-billion dollar corporate parent, was ever in danger of serving time.
Miles tried to have the company accept the terms for a three-year probation which consisted of:
1) Following the law and the Forest Practices Rules
2) Continuing the provisions contained in the "Stipulated Agreement"
entered into in late December 1998 by PL and the California Department of Forestry (CDF) for the purpose of issuance of the provisional Timber Operators License (the agreement set strict conditions for winter operations), and
3) Abiding by the provisions of PL CEO John Campbell's January 5 letter to PL employees setting forth how the company was to clean up its act.
When Miles asked PL to accept probation -- which would have held them legally to the terms they agreed to in negotiations with CDF -- in lieu of the fines, they refused, claiming that the money would set them free so why submit themselves to abiding by their public statements. Miles expressed disbelief at PL's choice, saying that she thought the issue was a matter for PL's reputation and that accepting the terms of probation PL would reassure the people of Humboldt County that PL would abide by its public statements.
Apparently, PL decided instead to simply buy their way out of compliance with the law.

ENVIRONMENTAL MOVEMENT GETS RELIGIO
A front page article in the Sacramento Bee on Tuesday, May 26, reported "[M]any Judeo-Christian faithful are becoming more energetic defenders of the natural resources they believe are part of God's original handiwork." The Bee cited the efforts to protect Northern California redwood forests by coalitions made up of Jews, Orthodox Christians, Baptists, and other denominations.
"There's sort of a moral authority there," said Ted Nordhaus of the Headwaters Sanctuary Project of the efforts of local clergy to meet with policy makers. "I think it's harder for political leaders to blow us off, particularly when they feel they're going to have to come home and explain their actions to their fellow parishioners."

LUTHERAN CHURCH PASSES RESOLUTION SUPPORTING HEADWATERS
The Sierra Pacific Synod, Evangelical Lutheran Church in America, adopted a resolution in support of protection for Headwaters Forest on Sunday, May 17, as part of its social statement "Caring for Creation: Vision, Hope and Justice."
The resolution reads, in part... "Whereas we of the Evangelical Lutheran Church in America are deeply concerned about the environment locally and globally, as members of this church and members of society...and
Whereas, negotiations are currently under way between our state and federal governments and Maxxam Corporation to purchase 7,500 acres of the 60,000-acre Headwaters Forest and its watershed for $380 million, and Whereas, the people and concerns of Humboldt County have not been represented at the bargaining table nor have key environmental organizations, and
Whereas, ancient redwood groves are an irreplaceable local, state, national and international treasure of unparalleled biological and spiritual value that is part of California's and this Sierra Pacific Synod's heritage, and an American legacy which we have the duty to preserve for future generations, and
Whereas, the Headwaters Forest comprises the largest privately owned and unprotected groves of ancient redwoods in the world, and its owner, the Pacific Lumber Company, has historically been committed to a policy of sustainable logging, has undergone a transition to new ownership in 1985 which brought about a change in policy toward that of accelerated and unsustainable timber harvesting, and
Whereas, the Headwaters Forest and its watershed is one of the last remaining habitats for a number of endangered species, and current discussions of plans for habitat preservation threaten to leave these species vulnerable to extinction and would exempt all other Pacific Lumber land from existing federal and state environmental regulations, and Whereas...we further recognize an imbalance in the stewardship of the ancient forest which threatens the sustainability of this diminishing ecosystem, in particular the Headwaters Forest and its watershed, therefore be it Resolved, that the Sierra Pacific Synod express its concern to the Maxxam Corporation and to the U.S. Deputy Interior Secretary that any Headwaters deal include both specific monetary measures to show care for Pacific Lumber employees and specific forestry measures to preserve the Headwaters Forest ecosystem and its watershed, and be it further Resolved, that the Sierra Pacific Synod in Assembly encourages congregations to ask their members to communicate with President Clinton, Interior Secretary Bruce Babbitt, the Deputy Interior Secretary, Senator Dianne Feinstein, their members of Congress, and their legislators, to support all efforts to obtain public ownership of all six ancient redwood groves of the Headwaters Forest and its watershed, and be it further Resolved, that we convey, through our Office of Public Policy, to the California State Senate and Assembly our full support of Senator Sher's and Assemblywoman Migden's protective standards of the Habitat Conservation Plan, before any State funding is released for the purchase of the Headwaters' Forest.

RELIGIOUS CAMPAIGN FOR FOREST CONSERVATION GETS UNDERWAY
A new religious coalition has formed to mobilize a wide range of faith groups in support of national forest conservation efforts. The coalition of Evangelical Christians, Catholics, Jews, Mainstream Protestants and Eastern Orthodox Christians will develop and promote a Judeo-Christian concern for forests and their conservation.
Ann Alexander, chair of the Christian Environmental Council, describes her motivation for involvement in the campaign: "As Christians, we do not see forests merely as a resource to be used and managed. Our Scriptures clearly teach that forests are a place where God dwells, and cares lovingly for His creatures who inhabit it. Our faith will always lead us to view forests as holy places, and not just as potential board feet of timber." DOWN TO THE WIRE IN THE LEGISLATURE...
CALIFORNIANS -- CONTACT YOUR ASSEMBLYMEMBERS AND SENATORS
Many thanks to all of you who made contact with budget committee members last week. Some of us were in Sacramento yesterday and the members we met with DEFINITELY got the message from the grass roots loud and clear. They also reiterated how important it is to hear from folks in their districts. The budget committee's votes went our way, with all of the Headwaters funding placed in Senator Sher's SB 533 trailer bill, which makes STRONGER protections for the forest a precondition of state funding, rather than as a line item in the state budget.
But it ain't over yet. We need co-authors for SB 533 to shore up the support in the Legislature and keep Governor Wilson from attempting a last-minute maneuver in budget negotiations. The following is a list of targeted senators and assemblymembers. If you see your representative listed here, please contact him or her with a message to support strong protections for Headwaters Forest by co-authoring SB 533.

WAR IN LEGISLATURE OVER HEADWATERS --
MIGDEN FLIPS AND FLOPS
Assemblymember Carole Migden (D-SF) has been the chief Assembly supporter of Senator Byron Sher's efforts to strengthen protections for Headwaters. However, yesterday's hearing in the Assembly resulted in near guerrilla warfare when Migden inexplicably attempted to block Sher's efforts by lobbying her colleagues to vote against Sher's bill, and to support Governor Wilson's plan to approve Headwaters funding with NO STRINGS ATTACHED, which would basically amount to a rubberstamp approval of Pacific Lumber's HCP. All the while, packing the hearing and the hallway were PL lobbyists and Wilson administration reps.
After several rounds of haggling in the hallway, Migden withdrew her objections and the Assembly budget subcommittee voted to reject the Wilson rubberstamp of the Pacific Lumber HCP, and to instead support Sher's SB 533 (detailed in last week's Update) as the vehicle for funding the Headwaters purchase.
Next Tuesday, the full Senate and Assembly budget committees will vote, and it is imperative that they back the decision of the budget subcommittees to improve the PL HCP. (Please see attached Action Alert to find out how you can help influence this critical vote!)

LA TIMES GETS IT RIGHT
The Los Angeles Times gave Governor Wilson some sound advice on Headwaters in an editorial on Friday. The editorial read, in part: "The big-ticket item in Gov. Pete Wilson's proposal to direct some of the budget surplus toward environmental improvement is the state's promised $130 million to buy 7,500 acres of virgin old-growth redwoods in the Headwaters Forest...but protection for these grand trees, the largest old-growth grove still in private hands, will be a pyrrhic victory if government officials do not force Pacific Lumber to slow the frantic pace of timbering on 192,000 acres of forest it owns adjacent to the old-growth Headwaters tract. That logging has already caused damage to local streams and hillsides that will take decades to repair." Lets hope Wilson AND Migden take heed.

56% IN TELEPOLL SUPPORT JULIA BUTTERFLY
The results of last weekend's Channel 3 (Eureka, CA) telephone poll are in, with Julia Butterfly coming out ahead by 12 percent. The television station's Friday evening newscasts featured stories on Julia and Pacific Lumber CEO John Campbell, and the station set up a telepoll for viewers to voice their opinions of the young tree-sitting activist. Of 15,193 total votes, 8,447 (56%) voted in support of Butterfly, and 6,746 (44%) voted against Butterfly.
With her typical humility Julia stated of the results, "That means we still need to reach 44 percent of the people here."

EVENT: FIDDLE DOWN THE FBI! Eight years after the car-bombing assassination attempt on Earth First! organizers Judi Bari and Darryl Cherney, activists will meet this Friday in San Francisco to "Fiddle Down the FBI" and demand the return of Bari's fiddle. The FBI has yet to return the instrument to the family of the famed activist/labor organizer/musician, even after charges against Bari were dropped.
Organizers of Friday's event at FBI headquarters urge rallyers to bring instruments of all kinds. "We will fiddle en masse in remembrance, and joy for the love of wilderness, the rights of working people, and the freedom of political dissent." Bari succumbed to cancer last year.

RIOT Theatre Company, in their 10th anniversary year, have moved into the flower selling business. Their production of the musical comedy "The Little Shop of Horrors" begins Tuesday 26th May and runs 'til Saturday 30th May at the Motherwell Civic Theatre.
Business in Mushnik's Skid Row Florists has been a little slow lately and it looks like the shop will soon close for good. Perhaps the last hope for Mr Mushnik and his assistants Audrey and Seymour, is a weird and exotic plant that Seymour recently purchased. The only problem is the plant's feeding habits - a "secret formula", as Seymour puts it, which is not Baby Bio.
The stage version of Little Shop of Horrors is packed with even more musical than its big screen counterpart. Rick Moranis, Steve Martin, John Candy and James Belushi all appeared in the 1986 movie.
With more music, an alternative ending and a very strange and exotic plant, the stage performance is not to be missed.

PACIFIC LUMBER CONTINUES TO DESTROY BELL CREEK AREA

For the past week Pacific Lumber Company/Maxxam has been logging ancient redwoods along Bell Creek, located just north of All Species Grove in the 60,000-acre Headwaters Forest.
Bell Creek is a critical component in the ecology of downstream coho salmon spawning habitat in Lawrence and Yager Creeks, and hosts its own population of steelhead trout.
On Wednesday, May 6, the tree containing the platform which was featured on the cover of the winter/spring Patagonia catalogue was cut down. Julia Butterfly had asked for people to gather on Monday, May 11, to hike to Bell Creek and the site of THP 188 to serve as the eyes and ears of the world as these ancient giants fall.
"People must see and hear as the trees fall in the forest," Julia stated. "Being deeply rooted in respect and love, our silence will speak louder than any words."
SYLVIA DE ROOY, 62, DESCRIBES MONDAY'S HIKE... "I gave myself an unusual 62nd birthday present yesterday. I spent the day on a trek into Bell Creek, at the northern end of the Headwaters complex. My 'tour guides' were a large contingent of beautiful young people, North Coast Earth First!
Their willingness to take an out-of-shape elder on that sizeable and difficult walk-in was amazing. What was even more amazing and wonderful was their loving, caring behavior. As we walked in, the early morning drizzle turned to full scale rain that never let up for the rest of the day. To give an idea of the trek, it took three hours to get back to our pick-up point, almost all up hill, often through mud, a creek crossing that took the help of four people to accomplish, and rain and more rain. I have never experienced a more heart-filled, passionate, and caring bunch of people. I was a liability and was not only never allowed to feel that I was, but all day there were hands, help, and care-taking around me. A tarp set up for me to sit under across from the tree sitters while some others took off to explore further. A sleeping bag from a tree sitter wrapped around my soaked and frozen feet. A pair of hands to rub my feet in the bag. A pair of woolen, dry socks found for my walk back. Never was I left alone.
Although there is not a part of me that doesn't hurt today, I'm left with a feeling of warmth and hope. Earth First! here in Humboldt County gets bashed endlessly and I want the world to know that this is a wonderful, wild tribe of people who, with huge hearts, take awesome risks, putting themselves into tortourous situations, and still have heart left to give. Their passion becomes, for me, a hope for the world. Thank you North Coast Earth First!"

I'm calling/writing to urge you to protect ALL OF THE ANCIENT TREES AND ENDANGERED SPECIES in Headwaters Forest. The current proposal by the Clinton Administration fails to meet even the federal agencies' own standards for protection for coho salmon, found in the Northwest Forest Plan.
Please make California State funding contingent upon an HCP that meets these standards. I urge you to protect this ancient forest, its endangered species, and California's substantial financial investment by supporting Senator Sher's SB 533.
Given the amount of money on the table -- $130 million taxpayer dollars -- the Legislature should insist that Pacific Lumber, at a minimum, meet the guidelines for endangered species protection outlined in SB 533. sincerely,

MAY:10:1998........ Department of Defense Investigators ignorant of their own data

During Operation Desert Storm, the U.S. aircraft A-10 “tank killer” fired 940,000 rounds of Depleted Uranium munitions, with another 4,000 rounds fired from the U.S. Main Battle Tank, the M1 Abrams, as well as by the British. By dividing the number of tank rounds by the approximate number of tanks used by the allies in Operation Desert Storm (1500), it is shown only about three rounds per tank were fired. This appears to show very few rounds were actually fired yet, anecdotal evidence from veteran tankers shows they fired the DU round almost exclusively due to its effectiveness at penetrating bunkers and Iraqi armor.

According to recent public reports or statements from the Office of the Special Assistant for Gulf War Illnesses (OSA/GWI), the current official Department of Defense position concerning use, exposure and contamination of U.S. military personnel by Depleted Uranium munitions during operation Desert Shield/Desert Storm is: 122 soldiers have been identified as being possibly exposed.

These include 50 soldiers of the 11th ACR involved in the Doha, Kuwait fire a few months after the war ended. This fire burned eighteen hours, and soldiers were sent in to clean up the fire after it had been extinguished. These soldiers were given no protective or respiratory equipment for protection from DU contamination even though a warning had been sent by EOD to the area to keep soldiers away from the downwind or contaminated area. The U.S. CENTCOM logs confirm the warning.
50 soldiers from the New Jersey National Guard unit 144th S&S Company who were involved in recovering/repairing vehicles hit in friendly fire incidents.
22 soldiers from various units that retained DU shrapnel after friendly fire incidents (down from an initial 33). The above figure of 22 includes NO military personnel who were exposed in other manners such as myself, (with positive test results) from being in, on or near equipment hit by DU rounds, or those of Captain Doug Rokke, (also tests positive) or his team members. Cpt. Rokke was head of the Depleted Uranium Assessment Team during Operation Desert Storm. Cpt. Rokke was retained on Active Duty by the military until late 1995. His work included determining contamination levels from DU impacts in the Nevada desert, or in developing training films to be used by military personnel to train them on the hazards of Depleted Uranium. Cpt. Rokke received commendations by the DOD for his significant work in this area.

It is also the position of the Department of Defense that those exposed will be offered a urinalysis test for the 122 military personnel that are concerned with their exposure and resulting contamination....if they request it.

Enclosed with this cover letter are several pages of documentation which show this position of the Department of Defense to be either a colossal misinformed blunder, or a blatant attempt at downplaying and ignoring the significance of the exposures, and attempts at falsely portraying the above veterans (and thousands of others) as being unaffected by their exposure to Depleted Uranium, as well as the hazards of Depleted Uranium. Since Dr. Bernard Rostker, Office of the Assistant Secretary on Gulf War Illnesses will not even hear a briefing from the person who headed the DU assessment team during the war, their investigation into Depleted Uranium use and exposures cannot be too serious.

In recent conversations with investigators of the Office of Gulf War Illnesses, they have stated a new, special investigation was started with the investigation headed by Mr. Pat Williams. > When I provided this information to a congressional committee aide, the DOD office then denied having a new, special investigation, and stated to him they had actually been investigating Depleted Uranium as a hazardous exposure since July 1995. Their "case narrative" will be coming out this month, September 1997. The incident surrounding Khamisiyah came to light in June 1996 and they have issued case narratives much faster than 2 years after the investigation started.

Also, during my conversations, investigators admitted they were aware of several "official" reports , yet still insisted only the above 122 soldiers were affected, and the urinalysis test would still be effective at this late date.

During one conversation with BG Jeff Prather, he mentioned participating in a "DU working group at Fort Belvior during the mid eighties".

I submitted a Freedom of Information Act request and was provided a 295 page response. Enclosed with this letter are the original request, the responding cover letter, and 76 pages from the material provided.

When reading the enclosed information from the response, keep in mind the dates of many of the documents, 1981 and 1984, then keep in mind the current position of the DOD GWI investigation. Also, keep in mind that one of the participants in this course, Maj. Jeff Prather, is now working for the DOD's GWI investigative team as a Brigadier General.

As you can see by reading the information from the response, the Department of Defense is VERY well aware of the significant potential of DU as an environmental and health hazard. Information contained in this response shows they are aware of the exposure of soldiers  from DU when it burns, aware of the downwind spreading and incidental contamination hazard, aware of the effectiveness or ineffectiveness of medical testing procedures for those exposed, aware of the inadequacies of the urinalysis test they are still offering, and aware of the much larger number of military personnel that were exposed.

Enclosed test data also shows the DOD is under-reporting the numbers contaminated with Depleted Uranium during friendly fire incidents, such as crew members who were also in the vehicle hit by a DU round, but did not retain DU shrapnel. Data in the response also shows the DOD is well aware of the avenues in which military personnel can ingest or be contaminated with Depleted Uranium, and which bodily organs would be affected by the exposure.

The DOD is further downplaying the seriousness of exposures to Depleted Uranium by often commenting publicly on the low hazard from radiation from a DU round, while totally ignoring the heavy metal toxicity of Depleted Uranium, and the effects it has when ingested.

For those no longer in the military the Department of Veterans Affairs is still, as of June 1997, offering the urinalysis test to Gulf veterans. In response to questions to a staffer within the Department of Veterans Affairs, Veterans Benefits division, I have been told that exposed veterans would have to claim their resulting medical conditions were secondary to their exposure to DU. This claim would then be sent up to someone, possibly the Secretary of the Department of Veterans Affairs. They would review all known data concerning the soldier’s whereabouts during Operation Desert Storm, and then provide their "best estimate" as to whether that veteran was exposed to DU, and whether that veteran’s medical condition was a result of their exposure to this hazard.

Many soldiers are exhibiting medical problems now which are known to be related to exposure to DU and need help now. Some have died. Some have required extensive surgery to continue living. Please help by disseminating this information. It will help change the “official” position. Sent in by................. an unknown reporter


MAY:09:1998............PROJECT. CENSORED'S. TOP. 10. OF.1997
Project Censored is a media analysis and research program based out of Sonoma State University; their stated goal is to "explore and publicize the extent of censorship in our society by locating stories about significant issues of which the public should be aware, but is not, for one reason or another." [In many ways, Project Censored was the inspiration for NewsWatch] They produce an edition of the Project Censored Yearbook annually, and circulate a press release of their "Top 10 Censored Stories" of that year. Their press release should be available at their website at http://censored.sonoma.edu/projectcensored, and the complete yearbook should be available at stores (for free access, demand it at your local library, or read it standing up at your local bookstore).
Let's all remember that for all the great work they do, that Project Censored has some fairly subjective judging. How is one subject "more censored" than another? I have noticed that Project Censored tends to put higher value on stories that involve the environment and human health. Both are extremely important, but other people could judge other subjects to be more important than these. And though PC doesn't explicitly state it, nearly all of its stories focus on the United States.
Now, to my summary of the Project Censored Top 10 of 1997.
_1. "Clinton Administration Aggressively Promotes U.S. Arms Sales Worldwide"_
Despite the passage of the Arms Transfer Code of Conduct, which supposedly bans "U.S. commercial arms sales or military aid and training to foreign governments that are undemocratic, abuse human rights, or engage in aggression against neighboring states," U.S. arms dealers continue to sell $10 billion to these governments every year.
Needless to say, the arms trade helps exacerbate conflict rather than solve it, and often saps the already limited resources of developing countries. Ironically, the Pentagon often justifies its huge spending on the development of new weapons by claiming that the U.S. must remain superior to the countries that are using the high-tech weapons we just sold them. And of course, the U.S. defense industry receives huge amounts of money from the government from the taxpayers via contracts, grants, subsidies, tax breaks, etc.
Currently, most U.S. weapons are sold to nations in the Middle East, but President Clinton has agreed to and a moratorium on transfers of high-tech weapons to Latin America.
_2. "Personal Care and Cosmetic Products May Be Carcinogenic"_
According to the American Food and Drug Administration (FDA) "a cosmetic manufacturer may use any ingredient or raw material and market the final product without government approval" (with the exception of seven specific toxins), but the FDA does have the power to pull dangerous cosmetic products from store shelves. The censored articles point out a number of examples of products which contain formaldehyde, nitrosamines, Cocamide DEA, TEA, titanium dioxide, and FD&C Blue #1, all known carcinogens (for those of you who are worried, the products in question are Clairol "Nice and Easy" hair color, Vidal Sassoon shampoo, CoverGirl makeup, and Crest toothpaste). Although the FDA asked the cosmetic industry to remove all N-nitrosamines from their products due to health dangers in 1979, very little action has been taken by any cosmetic company.
_3. "Big Business Seeks to Control and Influence U.S. Universities"_
It is common practice for companies and corporations to donate money to various colleges and universities, and no one would be that surprised to learn that these donors expect something back in return (after all, they _are_ businesses). These donations give donors access to university research, and also gives them scientists to argue their case, whatever it may be (even occasionally giving false information with their scientific credentials). The censored articles give many specific examples.
The articles also mention that the chancellors of some universities are also on the boards of directors for major corporations, which may be a conflict of interests.
_4. "Exposing the Global Surveillance System"_
The U.S. National Security Agency (NSA) and the New Zealand intelligence agency the Government Communications Security Bureau (GCSB) has been working with a secret intelligence alliance (the UKUSA: U.S., U.K., Canada, Australia, and NZ) to monitor most of the world's telephone, e-mail, and telex communication.
The project is called ECHELON. It works by indiscriminately intercepting large quantities of these messages, and then using computers to sort through them to find specific keywords. These messages are then save for future reference. ECHELON is primarily set up to spy on non-military targets.
This story was written by intelligence researcher Nicky Hager, when more than 50 intelligence workers who felt that the project had gone too far, leaked him the information. While this may all sound like some superparanoid fantasy, just remember that these are the actions of some of the most paranoid organizations on Earth, national intelligence agencies.
_5. "U.S. Companies are World Leaders in the Manufacture of Torture Devices for Internal Use and Export"_
In March of 1997, Amnesty International released a report about the use of electroshock weapons as torture devices. Of the 100 companies listed in the report who manufacture such devices, 42 of them were located in the United States. Amnesty and the American Civil Liberties Union fear that these weapons will be used by those in authority to torture and abuse those who are in their power (if they are not already). Most of these electroshock weapons leave no marks, and therefore leave no evidence.
Personally, I found this article a little weak as it seemed more speculation than fact.
However, taser weapons have been linked to fatalities, and one specialist believes that the death rates due to tasers will increase. And scariest to me, a new weapon is under development: "electroshock razor wire, specially designed for surrounding demonstrators who get out of hand."
_6. "Russian Plutonium Lost Over Chile and Bolivia"_
In November of 1996, a Russian space probe broke up in the atmosphere, and it's various pieces either burned up or landed in Chile and Bolivia. On board were four batteries containing about a half pound of plutonium altogether. The battery canisters have not been found; the plutonium could have vaporized in the atmosphere, or crashed to earth in some manner. Plutonium is of course, extremely toxic. At first, U.S. Space Command projected the probe's crash site to be in Australia. President Clinton offered U.S. help with handling potential radioactive cleanup. But when the true crash site was revealed, no new offers were made by the U.S. to help Chile or Bolivia. The Washington Post's headline for the story read "Errant Russian Spacecraft Crashes Harmlessly After Scaring Australia." Either plutonium is seen as harmless, or damage to non-Western nations is.
_7. "Norplant and Human Lab Experiments in Third World Lead to Forced Use in the U.S."_
I found this story particularly nauseating. Norplant is the brand name of a birth control drug that is administered by tiny devices surgically implanted under a woman's skin. Many nations will pay for the surgery to "install" a Norplant device (in the name of population control, or public health or something), but will not usually pay to have the device removed-- despite the fact that many terrible side-effects have been reported by Norplant subjects (including eyesight disorders, strokes, persistent bleeding, and others afflictions). In its earliest stages, the Norplant drug was tested on poor women from poor countries like Bangladesh and the Philippines. Now in the United States, some states (and perhaps the nation, with Senate Bill 5278) are attempting to make (or have already made) Norplant implants mandatory for women in certain situations (usually involving poverty). Norplant is manufactured by the Wyeth-Ayerst company. Over 400 lawsuits have now been brought against Wyeth-Ayerst representing 50,000 women.
_8. "Little Known Federal Law Paves Way for National Identification Card"_
The 1996 Illegal Immigration Reform and Responsibility Act has created a legal framework for mandating a national identification card for all Americans. Theoretically, this would be for the purpose of preventing non-citizens from using various public services, or gaining employment. One aspect of the law would make employers run potential employees' ID cards through a machine linked to the Social Security Administration, which could then approve or deny the applicant for employment. The government could actually gain veto power over private employment.
States are offered $5 million per year grants if they want to try to institute one of three ID programs. Additionally, federal agencies may only accept driver's licenses which fit the new specifications-- they must have the owner's fingerprints digitally encoded on a magnetic strip on the card. Georgia actually passed a bill instituting this ID program, but it was repealed after massive public outcry.
The author of this bill is California Senator Diane Feinstein, who wants a plan to be "immediately implement[ed]" that would force all Americans to carry an ID card with a "magnetic strip on it on which the bearer's unique voice, retina pattern, or fingerprint is digitally encoded."
_9. "Mattel Cuts U.S. Jobs to Open Sweatshops in Other Countries"_
Under NAFTA and GATT, the toy manufacturer Mattel, Inc. (of "Barbie" fame) cut a large amount of its workforce in the U.S. and moved their factories overseas. The censored articles were in-depth, personal stories of women working in these factories, under terrible working conditions, regularly having their right violated by fascist employers. Workers in a Bangkok factory have developed respiratory infections from fabric dust. Some have hair and memory loss, chronic pain in their hands, neck and shoulders, vomiting episodes, and irregular menstrual periods. Those who work in the factories who try to unionize or fight for worker rights are fired, threatened and intimidated. One worker who tried to unionize the Bangkok plant mentioned above was not only fired, but the company threatened to shut her up "forever." She said the following to a reporter, one of the most heart-rending and bitterly ironic comments I have heard in modern times: "Barbie is powerful. Three friends have already died. If they kill me, who will ever know I lived?"
But not to worry. Mattel, along with most of the toy industry, has adopted a policy of self-regulation. And if you can't trust ruthless, greedy corporations to work for the betterment of society, who can you trust?
_10. "Army's Plan to Burn Nerve Gas and Toxins Threatens Columbia River Basin"_
The U.S. Army plans to use $1.3 billion of taxpayer money to build five incinerators to dispose of obsolete U.S. chemical weapons (but I presume that the state-of-the-art chemical weapons will remain intact?) in Oregon's Columbia River Basin. The amount and variety of toxic chemicals and metals that will be released into the air and water is amazing, and will likely lead to increases in cancer, birth defects, immune system disorder, and neurological damage.
On top of this, the new incinerators will be modeled upon the Toole Utah Chemical Weapons Disposal Facility-- which has already been shown to be dangerous and shoddily built-- and the Johnson Atoll Chemical Agent Destruction System-- which has had a fire, an explosion, 32 internal releases of nerve agents, and two nerve gas releases into the atmosphere. And there is really no need to rush to dispose of these chemicals. The U.S. General Accounting Office finds that the chemicals can be safely stored as-is for 120 years, which would give time to find alternate, safer methods of disposal. A delay and review of technologies is supported by the National Academy of Sciences.

OLD-GROWTH DOUGLAS FIR FOREST TO BE CLEARCUT BEGINNING MAY 10
It was learned that the agencies will be reviewing the already-approved THP 307 and will submit their comments to the California Department of Forestry (CDF) within two weeks from April 27. This old-growth Douglas fir forest will be cut down this weekend, Mothers Day, May 10, if Pacific Lumber gets its way.
THERE IS NO TIME TO DELAY writing letters to the agencies declaiming:
1. No old-growth logging.
2. No logging in areas of high, very high or extreme landslide potential. 3. Federal agencies must have a veto power over CDF. Until approval is withdrawn, Pacific Lumber will feel free to begin clearcutting these ancient forests, as they have on Freshwater Creek. CDF IGNORES HEADWATERS AGREEMENT
Weak as the Headwaters Forest "Agreement in Principle" may be, the California Dept. of Forestry (CDF) still has difficulty upholding even the minimal protections it provides. The agency has approved four Pacific Lumber Company timber harvest plans, the latest in an old-growth Douglas fir forest on the Mattole River.
Senator Dianne Feinstein hailed the Agreement when it was signed on February 27. Six weeks later, CDF approved Timber Harvest Plan (THP)1-97-307 on April 8, WITHOUT THE MODIFICATIONS CALLED FOR in the Agreement.
Three other plans have also been approved, 97-235, along Freshwater Creek and THPs 97-473 and 491 along the South Fork Eel River. Plan 307 covers 118 acres of old-growth forest on Sulphur Creek, a steep tributary of the North Fork of the Mattole River. Of the 118 acres, 91 acres will be clearcut.
"At close to 3,000 acres, this is the largest stand of old growth in the entire watershed," says Freeman House, board member of the nonprofit Mattole Restoration Council. "It is also one of the only stands that is large enough to provide viable habitat for old-growth dependent species." More than half of Pacific Lumber Company's remaining stands of Douglas fir old-growth lie in the Mattole. According to PL's draft Sustained Yield Plan, over 2,000 acres of this forest will be clearcut in the next four years.

CALIFORNIA STATE SENATOR BYRON SHER AMENDS HEADWATERS LEGISLATION
Those "specified requirements" are addressed in some new amendments introduced by CA State Senator Byron Sher. The amendments to SB 533 basically incorporate the principles he and Assemblywoman Carole Migden laid out in the letter sent to Asst. Secretary of the Interior John Garamendi (see 4/2 Update). The new amendments would... 1. Make the requirements of the bill "self-executing," rather than simply requiring the Secretary of the Resources Agency to make specific "findings."
2. Require that the Habitat Conservation Plan prohibit commercial timber harvesting for 50 years without exception in the 12 listed "lesser cathedrals" and other remnant stands conserved as "Murrelet Conservation Areas." This is to prevent Pacific Lumber from seeking amendments to the HCP allowing for the release of one or more of the stands for commercial harvesting prior to 50 years.
3. The above provision requiring preservation of the 904 acres in Owl Creek for 50 years without exception is designed to PREVENT ITS RELEASE FOR HARVEST if Grizzly Creek acreage is acquired or preserved, as specified in the 2/27/98 framework agreement.
4. Establish minimum aquatic prescriptions that provide a 170-foot "no cut" buffer next to all Class 1 streams for 50 years, which is a "floor" that cannot be lowered by the Washington Dept. of Natural Resources watershed assessment process or sunset after three years.

Who says America's most beautiful people need to just be pretty movie stars? Tell People magazine that beautiful people aren't just beautiful on the OUTSIDE. Write in your vote for Julia Butterfly!
