    CALL FISH & GAME!
    Don't let Pacific Lumber get away with any more violations!

The latest logging violations by Pacific Lumber have seriously degraded
Bear River, a salmonid stream south of Headwaters (see adjoining Weekly
Update for details.)
    The Department of Fish & Game, the California Department of Forestry,
and Water Quality officials documented that PL knowingly violated their
timber harvest plan and caused serious damage to the stream in the presence
of steelhead fry and young-of-the-year.
    But now the Fish & Game Dept., which could impose a stiff penalty on
the company, is refusing to enforce the law and fine PL for these blatant
violations. They claim that the violations were "technical in nature," and
that they did not result in significant damage.
    The Fish & Game Code in section 1603.1 states "every person who
violates Section 1603 is subject to a civil penalty of not more than
twenty-five thousand dollars ($25,000) for each violation." Proving
irreparable damage is specifically not required to invoke enforcement
action under section 1603.1, but the record on the matter very clearly
documents that Bear River and the salmon did in fact suffer such damage
from these violations.

    Pacific Lumber destroys spotted owl habitat

In a related case, U.S. Fish & Wildlife is investigating recent actions
where Pacific Lumber cut down an active spotted owl nest tree, home to a
pair of owls, in Freshwater Creek. In Howe Creek, PL bulldozed a road right
up to another owl nest tree and harassed the nesting owls out of the tree.
Destroying or harassing an endangered species violates state and federal
laws. USFWS reports that it is investigating the matter.
    This case underscores the need for STRICT agency enforcement of the
provisions of the Headwaters Habitat Conservation.
    The agencies' actions in this incident do not inspire confidence in
their ability or willingness to do this. UNLESS THE AGENCIES IMPLEMENT AND
ENFORCE THE LAW NOW, why should we believe they will do so later?

    Please contact these officials and ask them to enforce
    their own rules and impose the maximum
    fine possible on Pacific Lumber.

1 TOP FOREST SERVICE SCIENTIST SLAMS HEADWATERS HCP
U.S. Forest Service Scientist Leslie Reed released a report last week detailing the inadequacies of the Headwaters Habitat Conservation Plan. Reid's report, requested by Congressman George Miller, says the Pacific Lumber HCP will cause more mudslides and damage to the endangered coho salmon populations. Reid is an expert on logging erosion and cumulative watershed impact. The report received front page coverage (with a huge headline!) in the San Francisco Examiner, and was also covered in the L.A.Times, Sacramento Bee, and the Eureka Times-Standard. 2 EVEN WITHOUT A LOGGING LICENSE, PACIFIC LUMBER RACKS UP VIOLATIONS But agencies refuse to impose fines
The latest logging violations by Pacific Lumber have seriously degraded Bear River, a salmonid stream south of Headwaters. In violation of Fish and Game Code 1603.1, the contractor (PL must operate through subcontractors) drove heavy equipment through Harmonica and Pullen Creeks and Bear River. A PL official directed workers and contractors to drive their loaded dump trucks, excavators and other heavy equipment repeatedly through this salmon stream at five locations instead of installing culverts as required by the Department of Fish and Game (DFG) and the company's own Timber Harvest Plan (THP). DFG, CDF and Water Quality officials documented that PL knowingly violated this agreement, causing serious damage to the stream in the presence of steelhead fry and young-of-the-year. So now they're slapping the company with big fine, right? Wrong. 1 FISH & WILDLIFE SERVICE OVERWHELMED BY 18,000 WRITTEN COMMENTS ON THE HCP
The number of comments received by the agencies is way beyond what we had even dreamed of. Apparently, the Fish and Wildlife Service has been so overwhelmed that they have not finished counting, but they estimate the total number of written comments to be about 18,000! The overwhelming majority of these are critical of the plan. Furthermore, this count does NOT include the oral comments made into public record at four California hearings in October and Nov. Agency employees are working furiously to sort and categorize the comments, and say that meeting the deadline for the final HCP will be a "challenge." THANKS AGAIN to all of you who took the time to participate in the process!

2 RALLY AND MARCH ON MAXXAM IN DOWNTOWN OAKLAND DEC. 2
Headwaters activists have teamed up with striking Kaiser Aluminum (Maxxam-owned) workers to demand an end to Maxxam's destruction of union jobs and of ancient forests. A rally and march will begin at 11:30am at the Oakland Convention Center at 10th and Broadway and proceed to Oakland City Hall (take BART to the 12th Street station). Oakland Mayor Elihu Harris, treesitter Julia Butterfly Hill (via cell phone), and labor leaders will address the crowd. 3,100 steelworkers have been on strike since September 30 over the radical measures Kaiser Aluminum has taken to "improve productivity," which include slashing over 400 union jobs. Since then, Kaiser/Maxxam has refused to negotiate in good faith and has continued its attempts to pressure laid-off Pacific Lumber workers to travel to Spokane to work as scabs. So far, few Pacific Lumber workers have taken the bait, and a busload of striking Spokane workers will travel to Scotia on Thursday to dissuade PL workers from scabbing for Maxxam.

3 PL PLEADS NOT GUILTY
On November 24 attorneys for Pacific Lumber entered a plea of not guilty in a Humboldt County court to eight criminal counts involving violations of the CA Forest Practices Rules. Six counts were for failure to comply with their own Timber Harvest Plans. All eight involved species habitat violations, including conducting illegal operations in spotted owl protection zones and sedimentation of fish-bearing streams, one so egregious that a four-count charge of failure-to-comply was issued. A pretrial hearing will be held December 15, Court 7, at 2pm.
